Terms & Conditions – Transformation Hair & Beauty Hobart TAS

Effective Date: 10/10/2025

These Terms & Conditions (“T&Cs”) form a legally binding agreement between Transformation Hair & Beauty (“we”, “us”, “our”) and any client (“you”, “your”) who books or receives services, purchases products, or engages with us in any capacity. By booking, attending, purchasing, or using our website, you acknowledge that you have read, understood, and agree to these T&Cs.

1. Scope

•    Applies to all services: haircuts, colour, foils, balayage, keratin treatments, extensions, facials, waxing, lashes, brows, nails, makeup, bridal/event styling, mobile and care-home salon services.
•    Applies to all products: retail items, gift vouchers, prepaid packages.
•    Applies to all bookings: salon, mobile, bridal, group, event.
•    Applies to all clients: in-salon, at-home, care-home, or online.

2. Bookings & Deposits

•    Mandatory deposit: All bookings require a deposit to confirm.
•    Non-refundable: Deposits are strictly non-refundable, except where     required by Australian Consumer Law (ACL).
•    Transfer of deposit: Permitted only where adequate notice is     provided (24 hours for standard, 48 hours for mobile/bridal, 30     days for bridal packages).
•    Unconfirmed bookings: Appointments are not guaranteed until the     deposit is received.
•    Group/bridal bookings: Require higher deposits or full prepayment;     non-refundable once confirmed.

3. Cancellations, Rescheduling & No-Shows

    Standard services: 24 hours’ notice required.
•    Mobile & event services: 48 hours’ notice required.
•    Bridal packages: 30 days’ notice required.
•    Late cancellations: Deposit forfeited.
•    No-shows: May be charged up to 100% of service cost; future bookings may require full prepayment.
•    Late arrivals: More than 15 minutes late may result in reduced service time or cancellation; no refund or adjustment given.

4. Payments

•    Timing: Full payment required at the time of service unless prepaid.
•    Accepted methods: Cash, EFTPOS, credit card, approved vouchers.
•    Pricing: All prices in AUD, inclusive of GST where applicable. Prices subject to change without notice.
•    Unpaid accounts: Outstanding balances, chargebacks, or dishonoured payments will be pursued via debt recovery, with costs payable by the client.
•    Promotions/discounts: Non-transferable, non-refundable, subject to specific conditions.

4. Payments

•    Timing: Full payment required at the time of service unless prepaid.
•    Accepted methods: Cash, EFTPOS, credit card, approved vouchers.
•    Pricing: All prices in AUD, inclusive of GST where applicable. Prices subject to change without notice.
•    Unpaid accounts: Outstanding balances, chargebacks, or dishonoured payments will be pursued via debt recovery, with costs payable by the client.
•    Promotions/discounts: Non-transferable, non-refundable, subject to specific conditions.

5. Services & Results

•    All services are tailored based on consultation, but results depend on your individual hair/skin/nail condition.
•    We do not guarantee exact replication of reference photos.
•    Colour results may vary depending on pre-existing pigment, condition, or history.
•    Extension, keratin, lash, and nail treatments require aftercare. Results are voided where aftercare is not followed.
•    Clients must follow all aftercare instructions provided by staff.

6. Mobile & Care-Home Services

•    Travel fees apply ($20–$50 per booking, POA for out-of-area).
•    Clients must ensure access, parking, electricity, water, and safe working space.
•    Services will not be performed in unsafe, unhygienic, or unsuitable environments; fees remain payable.
•    Client must be present, prepared, and available; unavailability results in forfeiture of fees.
•    Care-home packages: Monthly fees apply regardless of individual attendance; no partial refunds for absent residents.

7. Bridal & Event Services

•    Deposits: Non-refundable once confirmed.
•    Cancellations: Within 30 days = forfeiture of full deposit.
•    Trials: Separate charge; non-refundable once completed.
•    Party size: Reductions do not reduce the overall fee once confirmed.
•    Travel/time surcharges: Non-refundable once booked.
•    Contracted bookings: May require written agreements with clear payment schedules; binding once signed.

9. Refunds & Remedies

•    Refunds only provided where required by ACL (major service failure).
•    Minor issues will be corrected via re-do, partial refund, or store credit.
•    No refunds for change of mind, dissatisfaction with style preference, unrealistic expectations, or outcomes limited by client’s condition.
•    Refunds are not issued where corrections or re-dos are offered.
•    All refund requests must be submitted in writing within 48 hours of service.
•    Refunds processed only via original payment method.

10. Retail Products

•    Refund/exchange only if faulty, unsafe, mislabelled, or not fit for purpose under ACL.
•    No change-of-mind returns.
•    Returns must be unused, unopened, in original packaging, within 14 days.
•    For hygiene reasons, used/opened products cannot be returned unless faulty.

11. Conduct & Behaviour

•    Clients must behave respectfully towards staff and other clients.
•    Abusive, aggressive, or threatening behaviour will result in immediate termination of service with no refund.
•    Intoxicated clients may be refused service.
•    Children are welcome but must be supervised at all times. Unattended children cannot remain in service areas.

12. Health & Safety Obligations

•    Clients must disclose allergies, medical conditions, and product sensitivities.
•    Failure to disclose may result in adverse reactions; liability will not be accepted.
•    Certain treatments (bleaching, keratin, extensions) carry inherent risks. By booking, clients acknowledge these risks and consent.
•    We reserve the right to refuse treatments where safety concerns exist.

13. Out-of-Hours & Public Holiday Surcharges

•    Services outside standard hours or on Sundays/public holidays incur surcharges.
•    Once booked, surcharges are non-refundable.
•    Cancellations of such bookings forfeit deposits and surcharges.

14. Liability Disclaimer

•    Results vary depending on client hair/skin/nail condition.

•    We are not liable for:

o    Fading due to sun, chlorine, saltwater, or unsuitable aftercare.

o    Breakage or damage from client misuse.

o    Outcomes limited by pre-existing damage or prior treatments.

•    Our liability is capped at remedies required under ACL.

15. Intellectual Property

•    All website content, service descriptions, imagery, branding, and marketing material remain our property.
•    No reproduction, copying, or misuse is permitted without prior written consent.

16. Privacy & Data

•    Personal information is collected, stored, and used in accordance with our Privacy Policy.
•    By booking, clients consent to communications for confirmations, reminders, and marketing (if opted in).
•    We comply with the Privacy Act 1988 (Cth) and Spam Act 2003 (Cth).

17. Indemnity

•    You agree to indemnify and hold harmless Transformation Hair & Beauty, its owners, employees, and contractors from any claim, demand, loss, or damages arising out of:
o    Failure to follow aftercare instructions.
o    Failure to disclose health/medical conditions.
o    Misuse of products or services.
o    Third-party actions unrelated to our negligence.

18. Dispute Resolution

•    Complaints must first be made in writing to info@hairbeautyhobart.com.
•    We will investigate and respond within 14 business days.
•    If unresolved, clients may escalate to Consumer Affairs Tasmania or the ACCC.
•    Legal disputes will be governed exclusively by Tasmanian courts.

19. Governing Law

These T&Cs are governed by the laws of Tasmania, Australia, with jurisdiction vested in Tasmanian courts.

20. Final Authority

All service decisions, refund determinations, and enforcement of these T&Cs are at the sole discretion of management, subject only to rights under the ACL.
